La Superintendencia de Industria y Comercio cumple, en temas de competencia, funciones administrativas y jurisdiccionales de las que se ha ocupado, en la mayoría de los casos, la normativa. Sin embargo, existen cuestiones que no tienen respuesta, o respecto de las cuales, si bien esta existe, resulta ambigua. El objetivo de este artículo es analizar el alcance de las funciones administrativas y jurisdiccionales confiadas a la Superintendencia en asuntos de competencia, y con ello revisar, entre otras cuestiones, la naturaleza de sus funciones, su contenido, las autoridades encargadas de cumplirlas, los controles realizados por parte de la jurisdicción (ordinaria o contenciosa) a sus decisiones administrativas y jurisdiccionales. Así como plantear las distinciones entre las personas que administran justicia en la Superintendencia y los jueces habilitados para conocer de dichos procesos.

On topics related to competition, the superintendence of industry and commerce have administrative and jurisdictional functions which in most of cases have been dealt by the normative. However, there are issues that have no answer, or if there are any, they are ambiguous. Therefore, the aim of this article is to analyze the scope of the administrative and jurisdictional functions that have been entrusted to the Superintendence in matters related to competition and to review the nature of its functions, its content, and the authorities responsible for complying with them, among others. Additionally, it proposes a distinction between the people who administer the law at the superintendence, and the judges who are qualified to know those processes.
