La civilística moderna entiende que uno de los elementos de las donaciones entre vivos es su irrevocabilidad, por cuanto el donatario adquiere en forma definitiva lo que le ha sido donado. Sin embargo, no siempre ha sido así. La donación romana clásica tenía como nota distintiva ser lucrativa, la cual se fue equiparando a su irrevocabilidad. El objetivo de nuestro estudio es revisar, tanto en la doctrina romanística como en las fuentes romanas, el sentido de estos términos.

Modern civilistics understands that one of the elements of inter-living donations is their irrevocability, since the donee definitively acquires what has been donated to him. However, this has not always been the case. The classic Roman donation had the distinctive note of being lucrative, which was equated to its irrevocability. The objective of our study is to review, both the doctrine and the Roman sources, the meaning of each of these terms.
