Potestad reglamentaria sancionatoria en materia aduanera : la tipicidad y la garantía de reserva de ley

En Colombia, el régimen aduanero se configura a través de la denominada legislación compartida, surgida con ocasión de la figura de las leyes marco que comporta una interrelación entre legislativo y el ejecutivo, en tanto el primero fija pautas generales y el segundo completa la regulación, reconociéndose incluso la potestad de sustituir, modificar o derogar normas de carácter legislativo. Bajo este esquema, el Consejo de Estado defiende la tesis según la cual el aparte c del numeral 19 del art. 150 de la constitución de 1991 habilita al ejecutivo para definir el ámbito punitivo aduanero. Sin embargo, en esta obra se advierte que no es posible seguir una interpretación textualista y sesgada de la norma constitucional, en la medida que i) el constituyente sujetó la habilitación presidencial a “razones de política económica”, condición que es extraña a las normas sancionatorias y, ii) se impone un criterio sistemático que tenga en cuenta los valores y principios constitucionales que tienen por objeto no solo preservar el equilibrio de poderes sino también garantizar los derechos de las personas. Finalmente, la tensión que pueda suscitarse entre la reserva de ley y la necesidad de conocimiento técnico se resuelve a través de la tipificación indirecta.

In Colombia, the customs regime is configured through the denominated shared legislation emerged from the figure of the framework laws that entails an interrelation between the legislative and the executive, while the first sets general guidelines, the second completes the regulation, even recognizing the power to substitute, modify or derogate legislative norms. Under this scheme, the State Council defends the thesis according to which Article 150, numeral 19, section c of the 1991 constitution enables the executive to define the punitive customs ambit. Nevertheless, this work points out that it is not possible to follow a textual and biased interpretation of the constitutional norm, to the extent that i) the constituent conditioned the presidential authorization to “economic policy reasons”, a condition that is unrelated to the penalizing norms and, ii) a systematic criterion that takes into account the constitutional values and principles that aim not only to preserve the balance of power but also to guarantee people rights, is imposed. Finally, the tension that may arise between the legal reserve and the need of technical knowledge is resolved through the indirect typing.
