Inspección, control y vigilancia de las profesiones liberales: aspectos organizacionales y funcionales

Abstract

En el presente escrito se realizó un estudio del derecho a la libertad de escoger y ejercer profesión u oficio, cuya regulación por parte del legislador debe estar orientada a mantener un control sobre las actividades que contengan un riesgo social y un interés general intrínseco. A su vez, se analizaron las particularidades de la policía administrativa y las garantías en los procedimientos sancionatorios desarrollados por las autoridades administrativas, jurisdiccionales y particulares, que vigilan y controlan las profesiones en Colombia, denotando la importancia de satisfacer el principio de legalidad y en consecuencia el principio de tipicidad. De esta manera, se pone en evidencia las posibles dificultades y desatinos normativos, respecto al régimen sancionatorio ético- profesional que deben ser abordados en un futuro por las autoridades competentes.

In this writing a study was carried out of the right to freedom to choose and exercise a profession or trade, the regulation of which by the legislator must be aimed at maintaining control over activities that contain a social risk and an intrinsic general interest. At the same time, the particularities of the administrative police and the guarantees in the sanctioning procedures developed by the administrative, jurisdictional and private authorities, which monitor and control the professions in Colombia, were analyzed, indicating the importance of satisfying the principle of legality and consequently the principle of typicity. In this way, the possible difficulties and normative blunders are highlighted, regarding the ethical-professional sanctioning set of rule that must be addressed in the future by the proper authorities.
