Los avances tecnológicos en el campo de la genética humana y la medicina reproductiva han incrementado la posibilidad de evitar la transmisión de enfermedades, aumentar la eficacia de las técnicas de reproducción asistida e incluso pensar en salvar la vida de un hijo enfermo. Con estos avances han surgido preguntas en el campo del bioderecho, sobre el estatus jurídico del embrión, la posibilidad de encontrarnos ante nuevas formas de eugenesia y la necesidad, o no, de la intervención de los estados y la comunidad internacional, buscando que se garantice la diversidad genética y los derechos humanos. El diagnóstico genético preimplantacional, si bien se ha venido desarrollado por más de treinta años, es uno de los temas que más dilemas jurídico-éticos produce y el cual nos invita a considerar nuevas relaciones entre la ciencia y el derecho. Son diversos los instrumentos jurídicos que han abordado la regulación sobre los avances en la medicina reproductiva y cuales son los límites que deben imponerse para su práctica o si la misma debería prohibirse en determinadas situaciones.

Technological advances in the field of human genetics and reproductive medicine have increased the possibility of avoiding the transmission of diseases, increasing the effectiveness of assisted reproductive techniques and even thinking about saving the life of a sick child. With these advances, questions have arisen in the field of biolaw, about the legal status of the embryo, the possibility of encountering new forms of eugenics and the need, or not, of the intervention of the states and the international community, seeking to guarantee genetic diversity and human rights. Preimplantation genetic diagnosis, although it has been developed for more than thirty years, is one of the issues that produces the most legal-ethical dilemmas and which invites us to consider new relationships between science and law. There are various legal instruments that have addressed the regulation of advances in reproductive medicine and what are the limits that should be imposed for its practice or if it should be prohibited in certain situations.
