La monografía inicia abordando las generalidades del comercio electrónico, desde sus orígenes hasta su evolución. Posteriormente se hace referencia a la protección al consumidor del comercio electrónico en Colombia, señalando las diferentes figuras jurídicas que allí se contemplan hasta alcanzar el capítulo principal, que se refiere a la protección al consumidor en el comercio electrónico transfronterizo; en él, se plantea la primera gran pregunta que se hace siempre en esta materia, y que aún sigue sin una respuesta definitiva, y es: ¿Qué ley se aplica? Particularmente el capítulo enuncia las diferentes fórmulas y propuestas que se han hecho desde varios actores internacionales para solucionar este tipo de controversias, estudiando los procesos de integración regional como la Unión Europea o Mercosur. También pone de relieve el acuerdo ICPEN (The International Consumer Protection Enforcement Network) del cual es miembro Colombia. Por último, en este acápite se analiza el desarrollo que han tenido los sistemas de solución de disputas en línea: On-line Dispute Resolution ODR. Finalmente, se plantean los retos futuros que tienen los países para garantizar una protección más adecuada a los consumidores en un mundo globalizado, proponiendo alternativas que solo pueden ser logradas con el consenso y el apoyo de las instituciones multilaterales.

The monograph begins by addressing the generalities of electronic commerce, from its origins to its evolution. Subsequently, reference is made to consumer protection of electronic commerce in Colombia, pointing out the different legal figures that are contemplated there until reaching the main chapter, which refers to consumer protection in cross-border electronic commerce. In it, the first great question that is always asked in this matter is posed, and that still remains without a definitive answer, and that is: What law is applied? In particular, the chapter sets out the different formulas and proposals that have been made by various international actors to solve this type of controversy, studying regional integration processes, such as the European Union or Mercosur. It also highlights the ICPEN agreement (The international consumer protection Enforcement Network) of which Colombia is member. Finally, this chapter, the development of online dispute resolution systems is analyzed: On Line Dispute Resolution ODR. Finally, the future challenges that countries have to guarantee a more adequate protection for consumers in a globalized world are proposed, proposing alternatives that can only be achieved with the consensus and support of multilateral institutions.
