La violación de los derechos fundamentales a la igualdad y a la salud a partir del trato diferencial del trabajador dependiente en los efectos de la mora en el sistema general de seguridad social en salud

Esta investigación abordó el tema de la igualdad en la seguridad social en salud del trabajador dependiente en relación con el trabajador independiente y pensionado, cuando se presenta mora en el pago de los aportes al Sistema General de Seguridad Social en Salud (SGSSS). Se enfatizó en el derecho fundamental a la salud y la responsabilidad del Estado de garantizar la igualdad en el acceso y oportunidades, eliminando todas las barreras económicas y administrativas. Así, la problemática abordada se enfoca en el trabajador dependiente, a quien por incumplimiento del empleador en el pago de los aportes al SGSSS, le suspenden su afiliación en salud y la de su núcleo familiar y le genera el no reconocimiento de las prestaciones económicas. Ello en comparación con el trabajador independiente y el pensionado lo deja a él y a su familia en una situación de vulnerabilidad frente a las oportunidades de garantía en salud a las que pueden acceder estos. La situación descrita llevó al interrogante de si ¿El trato diferencial que se le brinda al trabajador dependiente frente al independiente y pensionado en cuanto a los efectos de la mora en el pago de los aportes al Sistema General de Seguridad Social en Salud es violatorio de los derechos fundamentales a la salud y a la igualdad? Frente a ello se abordaron los principios mínimos que deben garantizarse a los trabajadores dentro de los cuales se encuentra la igualdad y la seguridad social. Para finalmente valorar el trato diferencial mediante el juicio integrado de igualdad, estableciendo que dicho tratamiento carece de razonabilidad y justificación al existir alternativas distintas, respetables de derechos fundamentales.

This research addressed the issue of equality in social security in health of the dependent worker in relation to the independent worker and pensioner when there is a delay in the payment of contributions to the General System of Social Security in Health (GSSSH). The fundamental right to health and the responsibility of the State was emphasized to guarantee equality in access and opportunities, eliminating all economic and administrative obstacles. Thus, the problem addressed focuses on the dependent worker, who due to noncompliance by the employer in the payment of contributions to the GSSSH, their affiliation in health and that of their family nucleus is suspended and generates the non-recognition of economic benefits. This in comparison with the independent worker and the pensioner leaves him and his family in a situation of vulnerability in the face of the health guarantee opportunities that they can access. The described situation led to the question of whether the differential treatment given to the dependent worker compared to the independent worker and pensioner in terms of the effects of the delay in the payment of contributions to the General Social Security System in Health is a violation of the fundamental rights to health and equality? Considering this situation, the minimum principles that must be guaranteed to workers, including equality and social security were addressed. Finally, the differential treatment through the integrated judgment of equality can be assessed, establishing that such treatment lacks reasonableness and justification as there are different, respectable alternatives of fundamental rights.
