Una de las mayores novedades luego de la implementación del sistema penal con tendencia acusatoria fue la creación de mecanismos que permitieran la terminación anticipada del proceso penal. El principio de oportunidad, los preacuerdos e incluso el mismo allanamiento a cargos tomaron fuerza con la modificación constitucional que propició el acto legislativo 03 de 2002. Sin embargo, quince años después de la creación del sistema es fácil percibir cómo, no sólo se han mal interpretado algunas de estas instituciones, sino, que su entendimiento incluso ha dependido de la voluntad política de la jurisprudencia de turno. Este trabajo pretende dilucidar las diferencias estructurales y esenciales entre allanamiento a cargos y preacuerdos, concluyendo que, constitucionalmente son institutos divergentes, pues si bien hacen parte del derecho a terminar anticipadamente el proceso penal, la rebaja de pena en la primera es un derecho subjetivo, en la segunda, uno aspiracional.

One of the major novelties after the implementation of the criminal justice system with an accusatory tendency was the creation of mechanisms that would allow the early termination of the criminal process. The principle of opportunity, the plea bargaining and even the guilty plea took force with the constitutional modification that led to legislative act 03 of 2002. However, fifteen years after the creation of the system, it is easy to see how, not only have they been wrong interpreted some of these institutions, but their understanding has even depended on the political will of the jurisprudence of the day. This work aims to elucidate the structural and essential differences between guilty plea and plea bargaining, concluding that, constitutionally, they are divergent institutes, because although they are part of the right to finish the criminal process early, the reduction of the penalty in the first is a subjective right, in the second, an aspirational one.
