La sentencia del Tribunal Constitucional Federal alemán sobre la presencia de crucifijos en los salones de clase, conocida como el Kruzifix-Urteil, es una pieza jurisprudencial relevante para el estudio de la noción de la libertad religiosa y la relación del Estado con la Iglesia desde la perspectiva de un Estado secular. Este artículo hará un breve análisis sobre los argumentos del Tribunal para decidir que la presencia de crucifijos en los salones de las instituciones educativas públicas se constituye en una vulneración de la libertad religiosa. Así mismo, se describirán los efectos de tal declaración y de la discusión aún vigente sobre el símbolo religioso y su influencia en la libertad religiosa negativa.

The Kruzifix-Urteil case, decided by the German Federal Constitutional Court, is a particularly relevant decision to study the meaning of religious freedom and how does the relation between the State and the religion works in the light of a secular State. This paper briefly assesses the reasoning of the German Federal Constitutional Court to declare the presence of crucifixes in public schools as an infringement of religious freedom. Also, this document describes the impact of that statement on the negative religious freedom and the current discussion about the religious symbols and their influence in the scope and content of the negative religious freedom.
