Configuración discursiva frente al ofensor sexual de niños y niñas en Colombia, 2003-2012

Abstract

Se realiza un análisis de los discursos alrededor del ofensor sexual de niños, tal como aparecen en fuentes periodísticas, normativa nacional y literatura académica. El estudio se inscribe en la investigación documental, con perspectiva de análisis de discurso. Se identificaron cuatro discursos denominados: el criminal, el enfermo, el no humano y el sujeto de derechos. Se concluye que este tipo de sujeto se sigue concibiendo fundamentalmente desde el delito, por lo que las propuestas frente a su tratamiento no superan la díada castigo-rehabilitación, con una prevalencia del primero, que incluso instiga a la cadena perpetua, pese a que la misma sea una medida inconstitucional. Se encuentran referencias al sujeto de derechos, pero con menor frecuencia.

The study aimed to conduct an analysis of the discourses around the sexual offender of children, in journalistic sources, national regulations and academic literature. It corresponds to documentary research, with a perspective of discourse analysis. Four speeches were identified: the criminal, the sick, the non-human and the subject of rights. It is concluded that this type of subject is still fundamentally understood in his relation with the crime, so that the proposals regarding their treatment do not exceed the punishment and rehabilitation, with a prevalence of the first, which even instigates life imprisonment, although it is an unconstitutional measure. References to the subject of rights are found but less frequently.
