Daño a los derechos fundamentales en el ámbito del derecho de daños en Colombia : ¿resarcimiento o prevención del daño?

En epoca reciente, en el ambito del derecho de daños en Colombia los tribunales de cierre adoptaron como categoría autónoma de daño inmaterial el “daño a los derechos fundamentales”. Es constatable que su introducción como categoría de daño inmaterial ha producido cambios en la práctica judicial en el ámbito del derecho de daños, en especial, las operaciones interpretativas y argumentativas que realizan los tribunales para su reconocimiento y reparación. Mediante un análisis jurisprudencial en los eventos en los cuales se ha configurado un daño que lesiona negativa, definitiva y gravemente derechos fundamentales y se ordena una reparación, se pretende demostrar que existen buenas razones para admitir como categoría autónoma el daño a los derechos fundamentales, no obstante, éste debe circunscribirse únicamente a los eventos en que se configure una lesión grave a la dimensión objetiva de un derecho fundamental y su tratamiento debe efectuarse siempre bajo un enfoque de derechos. Queda latente la inquietud si su reconocimiento se encamina a reparar el daño o, por el contrario, se dirige a prevenir su ocurrencia, entendiendo que reparación y prevención son dos resultados posibles de la responsabilidad.

In recent times, in the field of damage law in Colombia, the closing courts adopted the “category of non-pecuniary damage as an autonomous category of damage to fundamental rights”. It is clear that its introduction as a category of non-pecuniary damage has produced changes in judicial practice in the field of damage law, especially the interpretative and argumentative operations that the courts perform for their recognition and reparation. Through a jurisprudential analysis in the events in which a damage that negatively, definitively and severely damages fundamental rights has been configured and repair is ordered, it is intended to demonstrate that there are good reasons to admit the damage to fundamental rights as an autonomous category, however, this should only be limited to events in which a serious injury is configured to the objective. dimension of a fundamental right and its treatment must always be carried out under a rights approach. The concern remains latent if its recognition is aimed at repairing the damage or, on the contrary, is aimed at preventing its occurrence, understanding that repair and prevention are two possible results of liability.
