El presente desarrollo temático sobre los delitos que afectan el servicio, tiene como finalidad determinar si algunos de ellos son de ejecución permanente o instantánea teniendo en cuenta la variación que ha tenido el Tribunal Superior Militar y Policial, al indicar que algunas de estas conductas son de ejecución permanente, tal y como sucede con el secuestro y el desplazamiento forzado, afirmando que esta situación puede aplicarse en otros tipos penales que afectan el servicio como el abandono de comando, abandono del servicio, abandono del servicio de soldados voluntarios o profesionales y la deserción; alterando figuras como la prescripción de la acción penal y la seguridad jurídica; lo que denota la necesidad de estudiar y un analizar en contexto tales posturas para ratificar que la tesis adecuada y que más se ajusta a su válida interpretación, es la que ha señalado estos tipos penales como de conducta instantánea. El trabajo se presenta en tres partes, la primera expone un recuento histórico de los delitos contra el servicio a través de las diferentes codificaciones penales militares, posteriormente se establece el concepto de los llamados delitos de ausencia para referirse a éstas conductas punibles, haciendo énfasis a su vez a la necesidad de señalar a la prestación del servicio como el verdadero bien Jurídico tutelado y no al servicio propiamente dicho y por último presenta un breve desarrollo dogmático y jurisprudencial de los delitos de ejecución instantánea y de ejecución permanente, estudiando a su vez cada uno de los planteamientos trazados por el Tribunal Superior Militar y Policial con los que varía la postura frente a algunos tipos penales contra el servicio, exponiendo igualmente los argumentos con los que se presentaron tales delitos hasta el año 2015 como tipos penales de ejecución instantánea.

The present development thematic about the crimes that affect the service, has the purpose of determining if some of them are of permanent or instantaneous execution taking into consideration that the variation of the Superior Military and Police Court has had, indicating that some of these behaviors are of permanent execution, as is the case with kidnapping and forced displacement stating that this situation can be applied in other criminal types that affect the service such as abandonment of command, abandonment of service. abandonment of the service of volunteer or professional soldiers and desertion, altering figures such as the prescription of criminal action and legal certainty; what denotes the need to study and analyze in context such positions to ratify that the appropriate thesis and that more closely rnatches its valid interpretation, is what has indicated these criminal types as instantaneous behavior. The work is presented in three parts, the first exposes a historical account of the crimes against the service through the different military criminal codes, then the concept of the so-called absence crimes is established to refer to these punishable behaviors, emphasizing in turn to the need to indicate the provision of the service as the true legal good protected and not the service itself and finally presents a brief dogmatic and jurisprudential development of crimes of instant execution and permanent execution, in turn studying each one of the approaches outlined by the Superior Milttary and Police Court with which the position varies in front of some criminal types against the service. also exposing the arguments with which such crimes were presented until 2015 as criminal types of instant execution.
