La problemática del uso indiscriminado del mercurio en diferentes actividades, especialmente en la industria minera del oro, ha generado múltiples cuestionamientos de diversa índole. En respuesta a esta problemática global, los países han negociado y adoptado un instrumento internacional para eliminar el uso de esta sustancia toxica que afecta gravemente la salud humana y el medio ambiente. Este es el Convenio de Minamata, el cual aglutina los acuerdos en torno a esta problemática. En este artículo analizamos su estructura como tratado internacional y hacemos un análisis de caso de la minería, recurso hídrico y mercurio en Colombia, y, finalmente, unas propuestas concretas para el Estado colombiano frente a esta situación que afecta a poblaciones vulnerables en el territorio nacional.

The problem of the indiscriminate use of mercury in different activities especially in the gold mining industry has generated multiple questions of diverse nature, in response to this global problem countries have negotiated and adopted an international instrument to eliminate the use of this toxic substance that affects This is the Minamata Convention, which brings together the agreements on this issue, in this article we analyze its structure as an international treaty and we make a case analysis of mining, water resources and mercury In Colombia and finally concrete proposals for the Colombian State in the face of this situation that affects vulnerable populations in the national territory.
