Este ensayo plantea un interrogante con respecto al contenido y alcance del derecho de tierras y la función que cumple en la sociedad. El Estado social de derecho contiene un sistema constitucional que configura su función. La intervención estatal tiene su fuente en un derecho social: la distribución equitativa de tierras en solidaridad con campesinos que carecen de ellas para su trabajo. La intervención del Estado en el territorio tiene en cuenta una planeación participativa que considera las variables social, ambiental, económica y cultural del campo colombiano. En tiempo de construcción de paz el derecho de tierras está guiado por los principios de la justicia transicional y, por ende, tiene un enfoque de reparación que atiende las causas del conflicto armado y su impacto en el despojo de tierras, el cual se ilustra con el desarrollo del cultivo de la palma de aceite en la región del Urabá, y su vínculo con los grupos paramilitares, factores que el derecho de tierras debe atender para garantizar la no repetición de los hechos de violencia en el campo. De no corregir dicho contexto de conflicto, los riesgos de ineficacia se reproducirán en los territorios afectados, y Colombia de nuevo aplazaría la atención de un fenómeno que está en la génesis del conflicto armado. El ensayo recoge las previsiones del Acuerdo de Paz sobre Reforma Rural Integral incorporado en la Constitución, y que marca una obligación del Estado en la justicia transicional para los próximos veinte años. Al final del texto se plantea una propuesta de reparación colectiva y simbólica, y unas conclusiones y recomendaciones.

This essay talks about the content and scope of land law, and its function in society. The social State of law contains a constitutional system that configures its function. The intervention has its source in social law: the equal distribution of land in solidarity with peasants who lack it for their work. The State’s intervention in the territory takes a planning into account in which the social, environmental, economic and cultural variables are considered. The essay sets that land law, during the construction of peace, is guided by the principles of transitional justice; therefore, it has an approach focused on reparation that attends the causes of the armed conflict and its impact on the dispossession of land, which is illustrated by the development of the oil palm in Urabá and its link to paramilitary groups. These are factors that land law must attend to guarantee the non-repetition of violent acts in the country region. If this context of conflict is not corrected, the risks of inefficiency would reproduce in the affected territories, and Colombia would once again will postpone its attention to a phenomenon that has been present since the genesis of armed conflict. The essay gathers the previsions of the Peace Agreement on the Rural, Integral Reform, which was incorporated in the Constitution and marks an obligation of the State in transitional justice for the next 20 years. In the final part, some conclusions and recommendations are presented.
