Uno de los elementos (lamentablemente esenciales) del contexto latinoamericano es la profunda desigualdad. Quizá sea más preciso hacer referencia a las desigualdades. Dentro de estas, uno de los dramas más acuciantes es la desigualdad estructural de género y su impacto transversal. De allí que el enfoque de género y la vocación transformadora sean fundamentales en toda decisión judicial. La Sentencia SU-201 de 2021 es una decisión que enfatiza en la centralidad de la perspectiva de género en la función de adjudicación. No se puede superar la desigualdad estructural de género si los poderes del Estado se basan en una visión formal de sus competencias. Esta resulta claramente incompatible tanto con los retos sociales que afrontan como con los generosos mandatos constitucionales y derechos humanos que orientan la acción de la autoridad. Esto vale también para el poder judicial. De allí que las decisiones extra y ultra petita, el principio iura novit curia y las medidas de reparación estructural pertenezcan menos a un esquema de activismo judicial y aparezcan como plenamente compatibles (y exigidas) bajo el paradigma del Estado constitucional.

One of the (unfortunately essential) elements of the Latin American context is deep inequality. Perhaps it is more precise to refer to inequalities. Within these, one of the most pressing dramas is structural gender inequality and its transversal impact. Hence, the gender approach and the transforming vocation are fundamental in all judicial decisions. The SU-201 Judgment of 2021 is a decision that emphasizes the centrality of the gender perspective in the adjudication function. Structural gender inequality cannot be overcome if the powers of the State are based on a formal vision of their competencies. This is clearly incompatible both with the social challenges they face and with the generous constitutional mandates and human rights that guide the action of the authority. This also applies to the judiciary. Hence, the extra and ultra petita decisions, the iura novit curia principle and structural reparation measures belong less to a scheme of judicial activism and appear as fully compatible (and required) under the paradigm of the constitutional State.
