La presente investigación plantea la posibilidad de atribuir responsabilidad internacional al Estado colombiano cuando los miembros de las antiguas Farc-EP no reparen a las víctimas del conflicto armado, en virtud de las obligaciones adquiridas en el marco del Acuerdo de Paz. Para ello, resulta pertinente analizar la naturaleza jurídica del acuerdo y su carácter vinculante en el ámbito internacional; identificar las obligaciones adquiridas por las partes firmantes del acuerdo; analizar el cumplimiento de esas obligaciones en materia de entrega de bienes a disposición de los ex miembros de las Farc-EP para reparar a las víctimas; y determinar el alcance de la responsabilidad internacional del Estado por la ilicitud del hecho en el marco del Sistema Interamericano de Derechos Humanos. Se llegará a la conclusión que, en ejercicio de la función de garante que tiene el Estado respecto de una obligación vigente, ante el desacato de cualquiera de las parte firmantes del acuerdo el Estado se subroga en dicha obligación, pese a no estar obligado a suscribir acuerdos de paz, o no comprometerse directamente con determinadas obligaciones, sino a través de un tercero

This investigation raises the possibility of attributing international responsibility to the Colombian State when the members of the former FARC-EP do not repair to the victims of the armed conflict, by the obligations acquired within the framework of the Peace Agreement. To this, it is pertinent to analyze the legal nature of the agreement and its binding nature at the international level; identifying the obligations acquired by the signatory parts to the agreement; verify compliance with these obligations regarding the delivery of goods at the disposal of former FARC-EP members for reparation purposes; and to determine the extent of the State's international responsibility for the wrongfulness of the act within the framework of the Inter-American Human Rights System. We can conclude that, in the exercise of the function of guarantor that the State has with respect to an international obligation in force, in the face of the contempt of any of the signatory parties to the agreement to guarantee the effective reparation of the victims, the State subrogates itself in said obligation, despite not being obliged to sign peace agreements or not committing itself directly to certain obligations, but rather through a third people.
