El auge de las consultas populares, en el tiempo más reciente, resultaron ser el mecanismo de participación con mayor impacto en las comunidades que se verían afectadas por la incursión de los proyectos minero – energéticos. Así, el propósito de este documento fue reconstruir el marco jurídico que las cobija, para identificar desde allí las limitaciones y alcances que tienen. Una vez identificados los instrumentos jurídicos que constituyen la regulación aplicable para la activación del mecanismo y lo que esto significa en términos de avances y retrocesos en materia de participación ciudadana e incluso las implicaciones que tiene respecto a la autonomía territorial, se ubicarán de forma sucinta otras herramientas que podrán ser alternativas para que las comunidades continúen incidiendo en las definiciones sobre sus territorios, los recursos naturales y el ambiente.

The rise of popular consultations, in the most recent time, turned out to be the participation mechanism with the greatest impact on the communities that would be affected by the incursion of the mining - energy projects. Thus, the purpose of this document was to reconstruct the legal framework that covers them, to identify from there the limitations and scope they have. Once the legal instruments that constitute the applicable regulation for the activation of the mechanism have been identified and what this means in terms of advances and setbacks in terms of citizen participation and even the implications it has regarding territorial autonomy, others will be briefly located. tools that may be alternatives for communities to continue influencing the definitions of their territories, natural resources and the environment.
