El desarrollo de las nuevas tecnologías ha tenido una incidencia fundamental en diferentes áreas del conocimiento, y el mundo jurídico no es la excepción. La referencia a los smart contract, a la justicia digital o a los delitos informáticos es prueba de ello. Esta influencia ha sido notoria en diferentes áreas del derecho, incluso en el ámbito del derecho de garantías. Efectivamente, las nuevas tecnologías han incentivado el recurso a las garantías al flexibilizar, por ejemplo, las reglas para su constitución. Igualmente, ha posibilitado el uso de registros electrónicos que permiten dotar a dichas garantías de una mayor eficacia. Estos no son sino algunos ejemplos que ponen en evidencia las grandes oportunidades de transformación que ofrecen las nuevas tecnologías en el ámbito del derecho.

The Development of new technologies has had a significant impact on different areas of knowledge including the legal world, in which case, it has not been the exception. The reference to smart contract, digital justice or computer crimes is proof of this, whose influence has been noticeable in other areas of law despite the fact that, in principle, it seems this incidence has been less recurrent ; this is the case of the right of warranty. Indeed, new technologies have encouraged the use of warranties by, for instance, making their constitution rules more flexible. Likewise, the use of electronic records has been made possible, making them more efficient. The aforementioned are examples highlighting the great transformation opportunities offered by new technologies in the legal realm.
