Los Proyectos Turísticos Especiales (PTE) a Gran Escala en suelo rural han sido impulsados por el Gobierno Nacional Colombiano como una prioridad. El Ministerio de Comercio, Industria y Turismo - MINCIT, dice que se convertirán en proyectos de alta importancia estratégica para el desarrollo o mejoramiento del potencial turístico del país y permitirán incentivar la inversión pública y privada en infraestructura turística. Por su parte el Viceministerio de turismo del MINCIT resalta que el desarrollo de proyectos turísticos en el país posiciona el turismo como uno de los nuevos pilares de la economía de Colombia. Es así como se expidió la Ley 1955 de 2019 y en su artículo 264 se modificó la Ley 300 de 1994 (Ley General de Turismo) y se ordena al MINCIT reglamentar los PTE a Gran Escala en suelo rural y al Ministerio de Ambiente y Desarrollo Sostenible, expedir los términos de referencia para la elaboración del PMA de este tipo de proyectos. En la presente investigación se presenta un acercamiento al régimen jurídico de los PTE notando un interés significativo del Gobierno Nacional en el ensamblaje de políticas públicas que dan paso al desarrollo e implementación de este tipo de actividades.

Large-scale Special Tourism Projects (STP) on rural land have been made a priority by the Colombian National Government. The Ministry of Commerce, Industry and Tourism (MINCIT in Spanish), asserts that STP will become projects of high strategic importance for the development and improvement of the country's tourism potential and will encourage public and private investment in tourism infrastructure. The Vice-ministry of Tourism of MINCIT emphasizes that the development of tourism projects in the country will position tourism as one of the new pillars of Colombia's economy. Thus, Law 1955 of 2019 was issued and its article 264 modified Law 300 of 1994 (General Tourism Law) ordering MINCIT to regulate LSTP on rural land and the Ministry of Environment and Sustainable Development to issue the terms of reference to conduct Environmental Management Plans (EMP) for this type of projects. This research presents an approach to the legal framework of LSTPs, noting a significant interest by the National Government in writing public policies for the development and implementation of these types of activities.
