La investigación tiene como objetivo realizar un análisis de las generalidades del comercio electrónico en el Estado colombiano, con el ánimo de dar respuesta a la pregunta de investigación ¿los mecanismos de protección previstos en el ordenamiento jurídico colombiano, garantizan los derechos del consumidor con respecto a las transacciones ejecutadas en el comercio electrónico?, para el efecto, fue necesario contextualizar en qué consiste el comercio electrónico, su evolución e historia, cuáles son las categorías que tiene esta forma de adquirir bienes y servicios, los mecanismos normativos y regulatorios de protección al consumidor, para lo cual es necesario efectuar una revisión sobre la legislación que se ha expedido sobre la materia, y una revisión de los casos que han sido objeto de investigación por parte de la autoridad que ejerce la vigilancia y control respecto de los actores que ejecutan actividades de comercio electrónico.

The objective of the research is to carry out an analysis of the generalities of electronic commerce in the Colombian State, with the aim of answering the research question: ¿do the protection mechanisms provided for in the Colombian legal system guarantee the rights of the consumer with respect to the transactions executed in electronic commerce? For this purpose, it was necessary to contextualize what electronic commerce consists of, its evolution and history, what are the categories that this way of acquiring goods and services has, the normative and regulatory mechanisms of protection to the consumer, for which it is necessary to carry out a review of the legislation that has been issued on the matter, and a review of the cases that have been the subject of investigation by the authority that exercises surveillance and control with respect to the actors that execute electronic commerce activities.
