La fiducia mercantil inmobiliaria de proyectos de construcción en Colombia es un negocio jurídico que tiene importantes impactos en aspectos sociales y económicos en el país, frente al cual surgen también unos cuestionamientos sobre el real papel que debe desempeñar la sociedad fiduciaria y su relación coordinada con los fideicomitentes promotores/desarrolladores, así como, frente a la necesidad de una mayor protección para el beneficiario de área, durante la fase de ejecución del proyecto constructivo. Este contexto permite analizar la configuración de un sistema negocial que involucra el vínculo funcional de varios negocios jurídicos, cuyo centro es el contrato de fiducia mercantil, con unas relaciones interempresariales y el cumplimiento de una finalidad común. Y como consecuencia del surgimiento de dicho sistema se generan unas obligaciones negociales, de carácter sistémico, a cargo de los fideicomitentes promotores/desarrolladores y la sociedad fiduciaria, a favor del beneficiario de área, relacionadas con unos comportamientos necesarios que se deben observar para el adecuado desarrollo y la conclusión de unas unidades inmobiliarias por enajenar.

The commercial real estate trust for construction projects in Colombia is a legal act that has important impacts on social and economic aspects in the country, but against which some questions also arise about the real role that the trust company should play and its coordinated relationship with the promoter/developer trustor, as well as the need for greater protection for the area beneficiary during the execution phase of the construction project. This context allows to analyze the configuration of a contractual system that involves the functional link of several legal acts whose center is the commercial trust contract, with inter-company relations and the fulfillment of a common purpose. And as a consequence of the emergence of such a system, some contractual obligations are generated, of a systemic nature, in charge of the promoters/developers trustors and the trust company, in favor of the area beneficiary, related to some necessary behaviors that must be observed for the proper development and the conclusion of real estate units to be sold.
