This paper aims to investigate the legal situation and the real status of mining on indigenous lands, their environmental effects, and the eventual legal consequences of deregulating this activity. First, the constitutional provision and the importance of regulating mining on indigenous lands are presented. Then, the position of the Federal Government on mining on indigenous lands is discussed. Third, it explains the Garimpos on indigenous lands in the Amazon and their status under the law and the Federal Constitution. Finally, it addresses the inappropriate use of an environmental good, classified as a common good, according to the Federal Constitution.

En este artículo se pretende investigar la situación legal y el estado real de la minería en tierras indígenas, sus efectos ambientales y las eventuales consecuencias legales de la desregulación de esta actividad. En primer lugar, se exponen los fundamentos constitucionales y la importancia de la regulación de la minería en tierras indígenas. Después, se aborda la posición del Gobierno Federal sobre la minería en las tierras indígenas. En tercer lugar, se explican los Garimpos en las tierras indígenas de la Amazonia y su situación según la ley y la Constitución Federal. Por último, se aborda el uso inadecuado de un bien ambiental, catalogado como bien común, según la Constitución Federal.
