La monografía tiene como objetivo analizar el contrato de concesión minera otorgada por el Estado, para la extracción de carbón, señalando las obligaciones de carácter laboral a cargo del empresario minero y las funciones de fiscalización minera a cargo de la Agencia Nacional de Minería; de otro lado pretende enmarcar la responsabilidad subjetiva del empleador por las omisiones en seguridad y salud a su cargo, en los términos del contenido del artículo 216 del Código Sustantivo de Trabajo y la posible responsabilidad del Estado a título de falla del servicio, de probarse las omisiones en lo que respecta a las funciones delegadas en inspección, vigilancia y control, en cuanto a la seguridad minera se trata. A su vez se aborda como las Administradoras de Riesgos Laborales se encuentran cumpliendo sus deberes de protección y promoción de la salud de los trabajadores mineros y las consecuencias en su gestión de los riesgos.

The objective of the monograph is to analyze the mining concession contract granted by the State, for the extraction of coal, pointing out the labor obligations in charge of the mining entrepreneur and the mining control functions in charge of the National Mining Agency; On the other hand, it intends to frame the subjective responsibility of the employer for the omissions in health and safety in his charge, in the terms of the content of article 216 of the Substantive Labor Code and the possible responsibility of the State as a result of failure of the service, to prove the omissions regarding the functions delegated in inspection, surveillance and control, as far as mining safety is concerned. At the same time, it is addressed how the Occupational Risk Administrators are fulfilling their duties to protect and promote the health of mining workers and the consequences in their risk management.
