This is where the legal problem of this investigation is established, this meant, whether Chapter XXII (general exceptions) of the international free trade treaties subscribed by Colombia-USA and Colombia-Canada, allow the Colombian government to "escape" certain normative precepts, which protect the Colombian government foreign investors when some very specific eventualities cocar whose objective is to guarantee the constitutional order such as protecting their biodiversity, social, economic, environmental, security and any other fundamental right.
