The Colornbian statute for domestic and international arbitration, Ley 1563 de 2012, is recognized as a dualist law and was designed and enacted with very clear objectives with the purpose of promoting the institution in our country. This thesis inquires about the implications of the Colombian dualist regimen of arbitration, with the intent to answer the questions of whether the law with its particularities fits into our constitutional concept of arbitration and if it results in a statute suitable for arbitration users. The investigation addresses the following four chapters: (i) the legal nature of arbitration from a doctrinal and jurisprudential perspective; (ii) the origin and historical development of international arbitration and its differentiation with domestic arbitration; (iii) the legal systems in the world regarding arbitration [monists and dualists]; and, (iv) a specific approach to the Colombian legislative model and sorne of its practical aspects.
