¿De la declaratoria de inexequibilidad del requisito de procedibilidad para demandar la nulidad de una elección por voto popular en el CPACA, se deriva la no exigencia del mismo a pesar de ser un requisito de orden constitucional?

The Legis/ative Act 01 of 2009, through its eighth article, introduced a new requirement to the constitutional text befare initiating the action of electoral nullity befare the jurisdiction, procedural requirement that was regulated in the sixth paragraph of article 161 of Law 1437 of 2011 -(PACA-, according to which, befare the declaration of the election, the claim must be made befare the corresponding electoral authority about the facts that arise during the voting or the scrutiny and that may result in an objective nullity of that contest electoral. The requirement of this procedural requirement has been a matter of controversy among the State Counselors of the Fifth Section, since there are those who oppose it by virtue of the fundamental right of access to justice, and after almos! 6 years of its regulation in the CPACA, that is to say in 2017, the requirement was subject to a public action of unconstitutionality from which its unconstitutionality was derived and has left a series of doubts about its application.
